NAACP Should Apologize for its anti-Jewish Shtick!

I would like to say a few words regarding some forces who ‘Kvetch’ often about the Board of Education of the East Ramapo (NY) Central School District: They are driven by hate!

They – The mid-Hudson and Westchester regions director of the National Association for the Advancement of Colored People (NAACP) , and the President of the Spring Valley, NY chapter of the NAACP – work officially to fight discrimination and to protect Civil Rights, but it is likely hate that drives them to file complains and publish negative reports against the Orthodox Jewish/Hasidic Board members who have a majority on the nine-seat School District’s BOE.

A sample of a disgraceful anti-Jewish move by the NAACP is the Press Release the Spring Valley chapter published in the afternoon of Monday, April 18, announcing that the US Department of Education’s Civil Right Division opened an investigation against The Board in response to a complaint filed by the NAACP. The problem? Well, the Federal DOE notified the NAACP and The Board in a letter dated ten days earlier – April 8 – about the inquiry. In fact, Wilbur Aldridge, director for the mid-Hudson and Westchester regions of the NAACP, told LoHud.com, the online edition of the Journal News, that news about the investigation came “last week,” (the week of April 10), yet the NAACP produced its Press Release only on Monday the 18′th, hours before the eight-day Passover holiday kicked in. With this deliberate delay, the NAACP limited  the ability of The Board to respond to the allegations in a timely fashion, since the Board adjourned for the holiday with its majority Orthodox Jewish/Hasidic members about to fully observe – without cell phone and electronic communications means – five of the following eight days starting with Sun Set of the 18′th.

The shameless act by the NAACP went a step further, including strongly misleading the press as to the will of the U.S. Department of Education. Wilbur Aldridge, the NAACP Mid-Hudson Director was quoted by the Journal News that “We cannot release any information as to what they’re looking at or what they’re looking for, but we do know that they have begun an investigation into the functioning of the East Ramapo School District,” and – reported LoHud – “adding that the U.S. Department of Education has asked [The NAACP] that the particulars of the investigation be withheld.”

The above information is contrary to what the Civil Right Office wrote to the ERCSD Board in its letter informing them about the Investigation. The Letter writes, “Under the Freedom of Information Act, it may be necessary to release this letter and related correspondence, and records upon request.” But again, the NAACP told differently to the press, likely with the goal to paint the Majority Jewish Board members in a dark light at a time when they hat limited-to-no reasonable chance to respond to the allegations.

It is a shame that people working for The NAACP, a group out there to advance the needs of minorities, uses religion and race to undermine members of another minority group while using severely handicapped and developmentally challenged kids as pawns. The disgrace grows even more when considering that the NAACP Spring Valley Chapter is located in one of New York’s most diverse villages whose Orthodox Jewish and Hasidic members shaped history eighteen months ago by making possible to elect New York State’s first Haitian American Mayor!

The Board Members at the ERCSD are using the success of the Private School system (where 2/3 of the local students are enrolled), to enhance multiple parts of the Public School system, most notably the Special Education division. This was done while keeping tax increases to a minimum; a move away from the past and a helpful move for locals in the troubling economic times of recent years. But from local groups and individual mouth-pieces, the Board gets mostly only complaints, fights, arguments and attacks, and at last this shameful act by the NAACP.

I hope the national NAACP will move to denounce its Spring Valley chapter and the Director of its Mid-Hudson and Westchester regions, and instruct them to work hand-in-hand with members of all communities for the good and the education of children in The District.

Muslims. Please Stop Crying and Step Up to the Plate

Since there is no/not many community – or leading – Muslims that speak out often in public against Radical Muslims, the Muslim community as a whole is in ways culpable of the anti-Muslim sentiments and distrusts that Americans have. You cannot sit on the sidelines and cry while people use your religion or faith to commit crimes against others, and then expect others to not have negative feelings against you.

When six Ultra Orthodox Jews flew to Iran in 2006 to the Holocaust Denying Summit, I had an op-ed (December 22, 2006) in the Rockland Journal News denouncing them, despite the fact that I personally know almost the entire group of six, and vice versa. Those in the Hasidic Community that claim that the acts of Israel causes hate crimes against Jews worldwide, don’t just cry about the acts against Jews. Instead, They bank-roll or raise money for the Jews Against Zionists  group that ran ads on the radio such as on WABC NY during the Limbaugh and Levin shows, and also ran this ad  in prominent newspapers denouncing the Israeli government.

So again, I am not saying that hating Muslims or any group is Kosher. As a grandson of Holocaust survivors I know it is no good.  But when 26% of young Muslims in the U.S. are ok with suicide bombs; when there are ten – or even more – terror attack by Muslim radicals and in the name of the Muslim religion for every terror attack committed by White Supremacists; when Muslims speak out in favor of – instead of denouncing – a project in NYC led by an Imam with openly anti-American views; when Muslims fear to speak out against the radicals in their community with the excuse or factual concern that the radicals are too powerful and thus will attack those who speak out, then indeed few can or should blame the American public for their doubts about radicalism in the Muslim community.

Beck is Leaving Fox? It Doesn’t Make Sense!

On any given day, Glenn Beck’s show at 5:00 PM Eastern on Fox News, has better ratings than Fox’s Greta Van Susteren’s show that runs at night, prime time shall we say. Susteren, regardless how weak she is versus the others in the evening at FNC, is still stronger than the hot-heads on MSNBC and the losers at CNN.  Therefore, it is strange the Drudge Report-posted pending NYT story that Fox and Beck will part ways.

Indeed, Beck being “extreme” may be the reason as to why Beck may end his career at Fox. However if he is extreme, in addition to having ratings way better than Maddow, Shultz and others, maybe MSNBC should hire Beck…

At any rate, if we look at the age 25-54 demographic, Beck indeed does not do so well as the overall number may suggest, but he still has good numbers.

Consider the average per day viewership that the following shows had Live (not replays) with the age 25-54 demographic for March first, second and third:

Matthews: 164,670

Ed Show: 268,670

O’donnell 280,670

Maddow: 367,670

Greta: 461,000

Beck: 464,670.

Hannity: 609,000

Oreilly: 856,000

Why the Anti-Government Right Wants to be Part of Government

You goto love the smarts of the Left when they point out that Republican say they are against Government, yet they still run for public office to be part of the government…

Well, by being in office, Conservatives can work to role back the size and power of government, and/or perhaps by occupying these public offices, the Conservatives – by just being elected – deny Democrats from holding these very positions/seats where they would expand government… Is this so hard to understand, my “smart” Liberal friends?

By the Numbers: Bush Beats Obama in Speech Viewership

With a President perceived to be strongly liked by the American public, it may seem strange to learn that his predecessor, George W. Bush – the one who is so despised by voters – actually had more people who watched his State of the Union (SOTU) Addresses than the amount of people who watch the speeches of President Obama.

Consider the numbers from Nielson:

ü  Obama’s current SOTU address was viewed by 42.7 million people. The Bush speech given in the same time, early the third year in office (2003) was viewed by 62.0 million people.

ü  Bush’s 2003 speech was given shortly before the start of Iraq War, which likely drove up viewership. However, a year later, Bush still had 43.4 million viewers, beating down Obama’s current number.

ü  Bush’s SOTU of early in his second year was viewed by 51.7 people, beating the 48 million of Obama’s second SOTU address.

ü  Granted, Obama’s first SOTU of 52.3 million was considerably stronger than Bush’s first SOTU that had only 39.7 million. However, the average viewers of Bush’s first three SOTU speeches, beats Obama’s first three by an average of 3.4 million per speech.

ü   The average viewers of Obama’s three SOTU addresses in addition to his joint speech on health care, is 42.4 million per speech. This is similar to Clinton’s last four SOTU numbers of 42.2 million, and only a little stronger than the 40.7 million average of Bush’s last four SOTU addresses (of which the first two includes only English-language networks, which means the worn-out Bush meets the popular  Clinton, and the freshly Obama).

ü  Side Note: Bush’s last SOTU address had 37.5 million viewers, versus the only 31.4 million who watched the last given by Bill Clinton.

The bottom line: Based on how Bush is beat down by some in the media versus how Clinton and Obama are hailed as the most loving things the American public has ever had, few would know that Bush handily meets and in some cases beats the above two presidents in the amount people who actually watched what he had to say.

Giffords on Fox: Take Out Your Anger and Resentment on the Politicians!

With all the talk of heated political rhetoric likely playing some role in the shooting of Arizona Congresswoman Giffords, it may seem surprising that the Congresswomen herself is guilty of using tough language. No, I am not blaming her for her own shooting. Her following statement however, illustrates that heated rhetoric is indeed the norm in today’s political discourse, and Palin – just as Giffords – cannot be blamed for the shooting.

Following the call of many, including some House Democrats, that other states and people in general should boycott Arizona over its new tough immigration laws, Dem Congresswoman Gabriel Giffords said the following on Fox News, June 30, 2010: If you’re angry at the politicians, take out your anger and resentment on the politicians, not over — you know, over the hard-working people.”

The interviewer, GVS, did not even blink on Gifford’s language. No, not because GVS is used to hearing it from Palin or Beck, but because this –again – is regular political talk that is used all the time by people on both sides, including by… Giffords!

As a side note: If you read the full interview, you see that Giffords on the immigration issue is anything but a Obama hack who supports the party line all the way, as it is the case with other Dems who somehow found now the high ground to lecture the Right over the Giffords shooting as if the hard core Left had anything nice to say on Giffords until the day of the shooting. As I asked: Did Obama stump for Gabby during her recent tough re-election campaign? Did Congresswoman Wassermann Schultz and Senator Gillibrand, the lead champs for “Gabby,” give monetary support for Gabby during the campaign? Or perhaps now, after shots were fired, Dems suddenly come to cash in on the tragedy?

Did Obama Ever Stump for Gabby?

You goto love how the Leftist Dems, such as Congresswoman Debbie Wasserman Schultz, and Senator Gillibrand who politically can’t stand Blue Dog Democrats, are now the biggest champs of their newly-found friend “Gabby,” the Blue Dog Democrat who was one of nineteen to vote against Pelosi being Speaker.

With the left so busy with their love for Gabby, I am wondering how many times – if at all – Obama campaigned personally for Gabby during her tough re-election campaign, and how much monetary support Schultz and Gillibrand gave for their Gabby during the last election cycle.

I am only asking…

Jon Stewart Gave us the 9/11 Bill?

In the punditry world, some are saying that comedian Jon Stewart gave the final push to the long-stalled 9/11 health bill by devoting a full show to this topic.

But the the fact is that Democrats wanted the bill pushed through with a $7.3 billion price tag, and Republicans wanted it half this side, because a large part of the bill had nothing to do with helping 9/11 rescue workers. Stewart pushed for the bill to pass in its original intent of $7-plus billion, and it passed only after being cut to $4.3 billion due to Republicans. So… where/how exactly did Jon give us this 9/11 bill? I mean, what are political insiders dirking these dats?

Government Pension Plans go Bust: Who CARES???

The NYT headlines a story that an “Alabama Town’s Failed Pension Is a Warning” to what other cities may face. But as far I am concerned, I don’t care much that public sector workers who for twenty-thirty years had incomes 1.5 time larger than tax payers, in addition to good benefits and comfortable working days/hours/vacations, will not have in their senior years all they were promised twenty years ago.
Worse, many people collecting pension are not even age fifty! So… if they have a problem how to pay their bills now that their pension has gone bust, they shall find another government job until age 65, or perhaps age 90 as lawmakers – backed by these very union members – do for the last 100 years.
My only problem is that Democrat-controlled states and cities will likely raise tax even more to cover these pension funds, rather than to shut the door once and for all on these crazy union contracts.

Wikileaks Gets a New ‘Follower’ Every Three Seconds

Check out the twitter feed of Wikileaks http://twitter.com/wikileaks  and refresh their page every few seconds. You will see that their Following grows by almost two dozen Twitter Accounts every sixty seconds. In fact, I checked the page when it was 258,984. Exactly a minute later the following was up to 259,004.

Apparently people are extremely amazed by the release of thousands of documents from the State Department.  But the Leaks’ Twitter feed directs mostly to Diplomatic Cables that may take too long to read until one gets to the juicy stuff. This work belongs to regular journalists. As a result, people will be better off if they check into regular news sites to get updates on the documents’ content.

O, by now Wikileaks has 259,147 followers. Sorry, I meant to write 249,157. Wrong again, it is 249,164.

You Lose $36; Banks Earn on it $69.50+

This is how it works: Your rarely-used account has $36.57. Not aware the balance is so low, you write a check to Mr. B in the amount of $65.00, which the bank rejects due to the low credit and low use of the account. The Bank slaps you with a Non Sufficient Funds (NSF) fee of $49.50, which leaves you $12.93 in the red. For every five days in the minus, an additional $10.00 gets charged by the Bank, and will continue until you read the next statement which may arrive ten days after the initial incident.

This is what happened recently with a client at M&T Bank in NY. The client – who saw the discrepancy just days after the check was written – was also liable $20 to Mr. B whose bank charged him on the faulty check. All in all, the client paid approximately $70 in fines and fees, for being short less than $29 on the initial check that M&T didn’t cover. If not for checking into the accoutn, $10 more would have been charged for every five days in the red.

Now we know how banks earn money…

Primary Night – Jewish Context

Look out for the following in the results of the strong Orthodox/Jewish NY areas. (The numbers may be pocket money in the context of the big picture, but for what it is worth, here is what to expect):

“The Orthodox and/or Hasidic Jewish Areas” are strongest Kings (Brooklyn), Rockland, and Orange. Westchester, Nassau and Riverdale in Bronx too (stronger with Orthodox Jewish areas).

Republican - Statewide:
 
- First Senate Seat, Joe DioGuardi got the Orthodox Jewish/Hasidic voters. Whatever amount it is, it is more than any other Statewide Repub. (In Kiryas Joel, Orange County, Malpas may have gotten some votes, same goes with Nassau and Westchester. However, Malpass or Blakeman prob have NO showing in Rockland or Brooklyn). 
 
- On the other Senate seat, few-to-none voted for the either of the two Republicans. In fact, some have placed my name “Yossi Gestetner” as a write-in…
  
- Lazio also got votes, but in total probably WAY less than DioGuardi – However in some areas he likely came closer to DioGuardi, say in KJ. If Paladino wins by a slim margin, Lazio will be VERY sorry for not going at it to the 18-35 age in the Orthodox/Hasidic street who are mostly fed-up with the Dems.
 
 
Republican – House Seats
  
Heyworth in NY-19, and Kleinahndler in NY-17 got almost all of the Jewish voters who participated. (in NY-19 prob more Jewish Repubs voted than in NY-17, and Wayworth may have gotten more Jewish Votes in KJ than DioGuardi). The other House seats, including where there is “Jewish Mone,” I ma not familiar at this time…
 
 
 
Democrats – Statewide:
  
– AG Fight:
 
Rockland County (which has Monsey and other Jewish pockets) is voice-Vote for Schneiderman.
 
Orange County (KJ area), probably WAY more votes for Cofee than Schneiderman.
 
Brooklyn, well it is Brooklyn and things should be all over the map, between Schneiderman, Rice and Coffee.
 
Wetchester and other places: Unknown.
 
TOTAL: If Schneiderman wins tonight, the Danvan Camp will have a field day with it in the Jewish Community. 
 
 
– Gillibrand’s Primary:
 
Few voted, and a few fans and friends placed “Yossi Gestetner” as a write-in to make some noise. (However, am too young to qualify, and I am a Repub in party registration).

The Democratics

As I pointed out on Twitter, Democrats are called ‘Democrats’ despite the fact that their party name is ‘The Democratic Party.’ For example: Schumer and Gillibrand are NY Democrats.

Now, why would we say ‘Schumer and Gillibrand are Democrats,’ but we will say ‘Schumer and Gillibrand, Democratic Senators from NY’? Why add this ‘tic’?

The answer is simple: Schumer’s initial party name was ‘Democrat,’ (and/or ‘The New Democrat’). But to fool voters into thinking that Democrats are “Democratic” while their opponents are Communists or what have you, the Democrats changed their party name to ‘The Democratic Party,’ but its members are still good-old ‘Democrats.’

Any time Democrats can brainwash voters about their intentions, the Democrats like to be called by their Party name, such as “Schumer, Democratic Senator from NY.” But old habits die hard so he and his buddies call themselves and are called ”The Democrats.”

To rub it into the Democrats, they should from now on be called ”The Democratics,” or in singular term ‘Democratic,” like Charlie Rangel, Democratic, NY.

The Democratics will sure hate that they are always named ‘The Democratics’, but if they can’t stand it, Democratics should ALWAYS be called Democrat/Democrats, and stop playing this undemocratic game…

By the way, does anyone know how many seats the Democratics will lose in November? Few think that my Congressman, a NY Democratic, will lose his seat.

I’ll be Running as a Democrat

I am a registered Republican with Conservative views on most issue. However, after long debate with close friends and supporters, I concluded that I will have to run for office as a Democrat.

The reason is this: Back in 2005, some people close to then-House Majority Leader Tom DeLay were embroiled in some corruption, or allegations of it. DeLay claimed he did nothing wrong, but to the constant drum beat of “corruption” and with the “support” of his colleagues, he stepped down from his powerful position and left Congress altogether.

This guy was cleared by the DOJ on August 16, 2010. Now let’s look at a different story.

In 2008, stories started swirling around another Congressman. Between others he was accused of “forgetting” annually to report to Congress rental properties he had outside this country, and was also accused of not paying tax on these earnings. However, despite these and other two-year-long accusations, and despite being recently indicted by the House Ethics Committee on a total of thirteen House violations (including things that are violations of the LAW, not just ‘House Rules’), this person is still a Congressman! 

If you wonder what the difference is between these two, look no further than their Party Line. Tom DeLay is a Republican, and the other Congressman, known as Charles Rangel, is a Democrat. As a Democrat, you stand a better chance to stay around with Chutzpa mostly because your friends circle the wagons for you – regardless if it is improper behavior in the Oval Office; regardless if you had shady property deals as a Senator from Nevada; regardless if as a Senator from NY, your staff dug up the Credit Report of a Black Candidate seeking office, and regardless if you are ‘sloppy’ while stuffing down your socks classified documents that can implicate you in being negligence regarding the 9/11 attacks.

As long you are a Democrat, you are good to go. However, if you are a Republican, the odds are that media reports will endlessly be against you, while your colleagues jump atop of each other to push you under the bus.

Due to all this, I decided that if I will be running for office, I will likely do it as a Democrat. This will increase the odds of not losing my job and reputation when being accused of things that I didn’t do (as it was with the DeLay). As a Democrat, I stand a chance of becoming Treasury Secretary and/or having all powerful people at my birthday party despite not paying thousands of dollars in tax on an annual basis.

Losing Objectivity by Being ‘Objective’

After writing in April at National Review Online an article headlined, “A V-Shaped Boom is Coming,” Larry Kudlow from CNBC wrote recently an article at RCP headlined, “The Economy Is Moving in the Wrong Direction.”

Back in his April piece, Kudlow wrote that we “could actually be turning into a full-fledged, V-shaped recovery boom between now and year-end. Conservatives shouldn’t trash it. I’m aiming this thought especially at many of my conservative friends who seem to be trashing the improving economic outlook — largely, it would appear, to discredit the Obama administration.”

Kudlow continued with his “smart” lecture to Conservatives:

“Don’t do it folks. It’s a mistake. The numbers are the numbers. And prosperity is a welcome development for a nation that has suffered mightily. Credibility is at issue here. Conservative credibility. Capitalist credibility.”

You see, I don’t have a problem when an economist is at times off the mark. It happens. Anyone can miscalculate. But the reason Kudlow made a fool out of himself with that V-shaped prediction, is because he wanted to come across as “objective,” as someone who – despite his Conservative tendencies – can still see the numbers of a great economic turnaround. He therefore went shopping for positive (and better than expected) news to make his case – which of course people on the left were happy to read.

But the fact however is, that the total economic stats of back in April, and Obama’s policies in general, made it clear that this economy is not going anywhere – a thing that many Conservatives and economists were saying for months, yet Kudlow missed it because he was busy being ‘objective.’

By wanting to come across as “objective,” Kudlow lost his real objectivity, a thing that happens to all “middle of the road” and “independent” opinion-shapers who yearn to come across as “open-minded,” when all they do is close their mind to see the real picture – all to score a few points with people on all sides of the political aisle.

Due to this, I like getting opinions from Conservatives – such as Rush Limbaugh – who don’t make apologies for being Conservative, and they appear to be more right than wrong in their analysis of things.

BP CEO Did a Fine Job

I am not being sarcastic: the ousted BP CEO Tony Heyward, which will serve until the end of September, did do a good job during this spill crisis – in the context of a CEO’s responsibility.

A CEO of a multinational firm with dozens of drilling operations, hundreds of exploration projects, thousands of workers, millions of shares on world markets, and billions of dollars in cash and assets around half the world, CANNOT have knowledge or control on all aspects of a deepwater disaster.

This of course is something that lazy bums in the media and big mouths on Capital Hill – who never held or studied a CEO job – don’t ‘get.’ And indeed, Heyward’s gaffes, which were few and minor to the gaffes of Obama and Biden, did certainly not help either. But all in all, a CEO of such a large firm can’t let go and forget of the rest of the firm just to be busy with one disaster, regardless how big it is or regardless what people in Congress have to say.

Finally, I don’t ‘get’ why people were mad that Tony enjoyed his Yacht outing a day after everyone applauded the fact that he was relieved of his oil spill duties. Why should Tony NOT be out on the yacht, if the oil spill ain’t his issue anymore?

In an Obama-era of blame, blame, and blame, this is the rethoric that you will get. I only wonder for how many months the new BP CEO will say that he “inherited this mess” and therefore things will get worse by each passing month…

Put Ice in Your Cell Phone

Christopher St. Lawrence (D), Supervisor of the Town Of Ramapo, in Rockland County NY, has recently published a letter asking all residence to enter an I.C.E., In Case of Emergency contact in their self phones. The gain? In case of emergency, say someone is found passed out, the arriving emergency personal should know where to call. They will flip open the person’s handheld device, search the Contact Section for ICE and dial the first or any other number posted to be reached In Case of Emergency.

This idea is probably not new, but I saw it first only recently. I think it is cool, depsite the “privecy issues” that some of my Conservative friends may have with this…

BP Should Fight the Government on Costs

I know it is in style to gang up on BP for the oil spill, but let me get straight to it: The United States Coast Guard (USCG), according to regulation, plan and/or law, is responsible to contain and clean up oil spills that affect the US waters, in addition that the ultimate command of all cleanup operations rests with the USCG.

Last August, seven months after Bush left office, the Coast Guard revised its reaction plans, which lawmakers – who should have oversight BEFORE A DISASTER – on the USCG, had no problem with the revised plans during the June 16 testimony of the five executives of large energy companies whose reaction plans were attacked as flawed and insufficient.

Beyond the responsibility that BP has for plugging the damn hole and some damage that has accrued since then, it should be the Federal Government, who’s Coast Guard has failed in its task, that should pay for the clean-up of the coasts, lost fisherman’s work, and all other dirt that comes with this mess.

If BP, according to law and regulation, were the sole, top responsible and authorized power in the Gulf, then hands down Obama should suck’em dry. The fact however is, that the USCG has top control of how things go or don’t go there. Therefore, BP should NOT let Obama have $20 billion as a down payment. Instead BP should fight back with legal and PR means by pointing how moves and inaction of the Coast Guard permitted more oil to reach deeper into shorelines, and theretofore the Federal Government should take responsibility of at least half the clean-up cost. (Besides this point, let’s not forget that STUPID government policies sent the oil firms fifty miles out, thousands of feet deep to get oil, where it is difficult to stop spills. Therefore, the government should have more than a mere 50-50 liability to cleanup – and pay for – this mess).

If BP will without a challenge continue giving into Obama’s and the Dems’ demands such as the $20 billion account and the additional $100 million for workers who don’t have work due to Obama’s moratorium, the firm will ‘VERY likely’, as I tweeted on June 14, collapse/go into bankruptcy, because as far some on the left are concerned, $20 billion is just a down payment. If this approach goes unchallenged, BP will sink into the oily ocean.

Almost 70% Hispanics Vote Dem!

Some point out that it is “no surprise” that 70% Hispanics in a new WSJ poll are against the Arizona Immigration Laws. To some, the “no surprise” is that the Law will likely effect mostly Hispanics, and therefore they oppose it.

But, no. The No Surprise of the Poll results is due to the fact Hispanics vote for the Dems BIG time even when the pro-leftist-reform McCain was runing.

Here’s how the Hispanic vote went recently:

67% Voted for Obama in 2008 (only 32% voted for  McCain).

69% Voted for the Democrats in 2006 congressional elections.

55% Voted for Kerry in 2004

65% Voted for Gore in 2000

So… the 70% opposition is just a matter of Party Line.

Note: is it not racist to take a poll based on racial lines regarding a “racist” law? Am just asking…

Injustice and Persecution Against a Non-Unionized Businessman

Some people in the U.S. remember the raid by federal agents that took place in May of 2008 on the Agriprocessors meat plant in Iowa, but few know the gross injustice and persecution that went on from day one, and still continues today.
 
The raid took place due to two sins of Agriprocessors: 1) Almost 400 of the plant’s 700 non-unionized employees were allegedly illegal aliens. Although a lot of them pleaded guilty later, charges of wrong-doing on the part of the Agri bosses were later dropped because there was no proof that the firm hired the workers knowing that they were here illegally. In fact, a federal agent who tried getting a job there while providing visibly fraudulent papers was turned down twice. Only when that agent returned with the real thing, he was accepted to work there. In addition, Agriprocessors paid payroll taxes on all employees working there – funds that I doubt will be returned to the company by the government despite learning that alot workers were illegal. In other words: The federal government is having the cake and eating it at the same time. Just like that.
 
The firm was levied heavy fines for failing to pay workers and file other paperwork for a six-week period AFTER the federal raid took place, which essentially crippled the firm to its bone. The Feds also made noise about 32 underage people working at the plants – you know, a thing that never happens in America, i.e. underage people working to earn some pocket money. Despite dropping the immigration charges, prosecutors used immigration issues to convince a jury to convict the company’s leaders, or for what I call the second sin.
 
Sholom Rubashkin, a Vice President at the plant, inflated the firm’s receivables to get a larger line of credit from a local bank. The bank earned millions in interests during the life of the line of credit. However, only after the Feds seized the assets of Agriprocessors and forced the firm into bankruptcy, the bank lost $26 million of unpaid debt, which federal prosecutors conveniently use as a “$26 million bank fraud” talking point to chastise Rubashkin and to have him sit behind bars for a life sentence.

This is not even half the story.
 
A main player in this case from the get-go was Stephanie Rose who during the May 2008 raid was a lead assistant in the US Attorney’s Northern Iowa office.  In 2009, Senator Tom Harkin (D-Iowa) recommended to President Obama that Rose be nominated as US attorney. Her nomination was criticized by some on the Left as a result of her harsh treatment of immigrants during the raid. Regardless, she won Senate confirmation to be U.S. Attorney.
 
At any rate, prosecutors requested a very high bail for Rubashkin, and then for a while didn’t want bail altogether, claiming that since he is a Jew, he is a flight risk to Israel. The Feds dramatized that $20,000 (or whatever big amount of) cash was found in the safe next to his family’s passports. Of course, neither prosecutors nor Judge Linda Reade (Nominated by GWB in 2002 on the recommendation of Senator Chuck Grassley, R- Iowa), reckoned with the fact that $20,000 in a safe for a wealthy businessman is like $250 for a regular person, and in no way was it a plan to escape. Besides, seizing Rubashkin’s passport and placing an ankle-bracelet on him could have eliminated the flight risk. But this didn’t – for a while – calm the Judge and prosecutor.
 
After being behind bars well before the court date, and after being found guilty five months ago on 86 counts of bank fraud chargers, the Judge ordered Rubashkin (currently represented by Nat Lewin) to stay behind bars until sentencing, which is dated for April 28, 2010. Worse, due to being hit repeatedly by a cell-mate in the Linn County Correctional Facility, the judge ordered Rubashkin into solitary confinement “for his own protection.” For weeks now, he is held there for 23-plus hours a day, without getting a haircut or a warm Kosher meal in the last few months! But of course, releasing him to his home and family “for his own protection” until sentencing date is – according to the Judge – not an option…
 
According to those involved in the case, some of the overzealousness and injustice of the prosecutor and Judge, also include the following:

  • The Feds carried out the headline-grabbing, yet destructive raid, which destroyed 1) the business; 2) the local economy; 3) and the bank that lost money, DESPITE the fact that Robert W. Kent, Esq., of Baker & McKenzie, offered to work this out peacefully with the U.S. Attorney’s office, as prosecutors often do before they rain down indictments on people. 
  • The counts against Rubashkin were multiplied to make him come across as a mean-spirited, self-serving crook. Prosecutors went so far as charging him with a law of the Stockyards Act of 1921 that no other meatpacker (in recent history) was charged with.
  • Despite the fact that defendants in similar cases in recent years were not even charged, (such as at Swift & Co); were given probation, (such as at Action Rags, and Mr. Zhu of Miyako Sushi); or received a prison term of one year, (such as Francesco Insolia of Michael Bianco), prosecutors here are recommending a 25-plus year/life sentence for Rubashkin.

The list of wrongdoings goes on, including using wobbling witnesses to convict Rubashkin, and relying on writings from racist groups to propel negativity against Rubashkin. All in all, it does not make sense that a large employer was driven out of business from an area which was essentially dead before the business expanded, all for doing something that most Americans do: inflate income to gain access to credit for a business, money which Agriprocessors always paid up, until the Feds destroyed the business. While no one is saying that such a thing is Kosher, everyone can agree that serving a year in prison, and/or some money penalty with a short house arrest, makes more sense than the current route taken by a country that has The Best Justice System in the World.
 
More than 25,000 concerned citizens have already signed the petition that will be sent to the prosecutor asking her to reconsider her position on the sentencing. It is hopeful that the media, pro-business groups, civil rights organizations, and Congressional Judiciary Committees will all review this case in more detail, and demand that the prosecutor and Judge be held accountable for their demeanor in all of this, and that Senators Harkin and Grassley should be asked if they support or oppose the Judicial abuse that is being carried out by people that they, the Senators, recommended to serve at those current posts.


Unchecked abuse of judicial power is destructive to America’s values, businesses and people, and cannot be allowed to continue the current way.

The “Harassing” of the Parks Family

After Martin Grossman’s death sentence was carried out, a press conference was held by the Park family. Ms. Betsy Park, the sister of Peggy Park, the Wildlife officer killed by Grossman, said as follows: “we were harassed over the past week, and I think it is reprehensible for any cause.” I didn’t hear directly from Park that she meant harassment from Jewish groups. However, some news agencies implied, and others said explicitly, that the harassment came from Jews.

I would like to set the record straight here:

No leader of the Orthodox Jewish community, and nor anyone working on their behalf, did any type of harassment to the Park family. I cannot take responsibility if some renegades within the Jewish community did things on their own that irked the Park family. (I am not even aware that such things took place.)

The only “harassment” that came from the Jewish community was an offer to bring closure to the Park family in form of memorializing the dedicated work of Peggy Park, by laying the groundwork for a Foundation that would help the families of Law Enforcement officers who die in the line of duty. In exchange for this foundation – that would have gotten a six-digit figure to get off the ground – the Parks family would agree to inform Governor Crist that from their end, they are not seeking the death penalty at the current time.

Considering that the effort to gain a 60-day stay of execution for Grossman was running against the clock, extraordinary efforts were put in motion to get in-touch with the Park family. After ongoing debates, the family’s final and unequivocal decision was that they will try getting closure via the execution of Grossman, which was fully within their right. The working group had hoped for a different outcome, but following the carrying-out of the Grossman sentence, the group didn’t question the judgment of the Park family.

Thank You, Mr. Crist! Thank You!

All of us across the United States need to thank Florida Governor Crist for standing up for justice, by signing the death warrant of Martin Grossman, whose sentence was carried out Feb 16, 2010.

By letting the Grossman execution to go forward without a 60-day stay, Crist sent a clear message to Floridian orphans who are under the legal drinking age, with low IQ’s, on prescription/street drugs, who are under the influence of slick/wild friends, that taking an innocent life without any advance plan, especially the life of a Law Enforcement official, is no child’s play. We are confident that those people under such circumstance who get caught in the moment, will stop what they are doing, and say to themselves ‘hold it, hold it, hold it. Grossman was killed; I don’t wanna share his fate.’ As a result, these youngsters, on drugs, with mental limitations, and with low IQ’s, will refrain from committing an on-the-moment killing.

Good job, Charlie.

In addition, we have to thank Mr. Crist for sending this message to wild youngsters: If you are involved in crimes, you just need to blame everything on your fellow friend, especially if that friend has limited mental/legal defense abilities. And then of course, if you commit suicide 11 years later, out of guilt that you testified against/framed the mentally-challenged friend, then no bad feelings there either. Better yet, 15 years after the suicide, the Governor of your state will not even mention your name while giving to the public so-called details of the crime.
